By accessing or using TradeTrkr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and TradeTrkr.
TradeTrkr is a trading journal and analytics platform that helps traders track their performance, analyze their trades, and improve their trading psychology. The Service includes:
Trade logging and management
AI-powered trade reviews and insights using Anthropic's Claude
Daily and weekly review capabilities
Performance analytics and statistics
Trading psychology tracking and check-ins
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
To access certain features of the Service, you must create an account. You agree to:
Provide accurate, current, and complete information during registration
Maintain and update your account information to keep it accurate and current
Maintain the security of your password and accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account
Not share your account credentials with others or allow others to access your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.
TradeTrkr offers subscription-based access to premium features:
Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe
Auto-Renewal: Your subscription will automatically renew unless you cancel before the renewal date
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period
Refunds: We offer a 14-day money-back guarantee for new subscriptions. Refunds after 14 days are at our discretion
Price Changes: We reserve the right to modify subscription prices with 30 days' notice
Payment Failures: If payment fails, we may suspend your access until payment is resolved
You retain ownership of all content you submit to the Service, including trade data, journal entries, screenshots, and reviews ("User Content"). By submitting User Content, you grant us a limited license to:
Store, process, and display your User Content to provide the Service
Send your User Content to Anthropic's Claude API for analysis and review generation
Create aggregated, anonymized statistics for service improvement (no personally identifiable information)
You are solely responsible for your User Content and warrant that you have all necessary rights to submit it. You agree not to submit content that:
Violates any applicable law or regulation
Infringes on intellectual property rights of others
Contains malware, viruses, or malicious code
Is defamatory, obscene, threatening, or harassing
The Service uses Anthropic's Claude AI to generate trade reviews and insights. You acknowledge and agree that:
AI-generated content is provided for informational and educational purposes only
AI reviews are not financial advice, investment recommendations, or trading signals
AI-generated content may contain errors, inaccuracies, or limitations
You should independently verify any insights or recommendations before acting on them
We are not responsible for trading decisions or losses resulting from AI-generated content
IMPORTANT: TradeTrkr is NOT a financial advisor, broker, or investment firm. The Service does not provide financial, investment, or trading advice. All content, analysis, and insights provided through the Service are for educational and informational purposes only.
Trading and investing involve substantial risk of loss. Past performance does not guarantee future results. You should consult with a qualified financial advisor before making any investment decisions. We are not liable for any trading losses or financial damages you may incur.
You agree not to:
Use the Service for any illegal purpose or in violation of any laws
Attempt to gain unauthorized access to our systems or user accounts
Reverse engineer, decompile, or disassemble any part of the Service
Use automated systems (bots, scrapers, etc.) to access the Service without permission
Interfere with or disrupt the Service or servers
Resell, redistribute, or commercially exploit the Service without authorization
Abuse rate limits or attempt to circumvent usage restrictions
The Service, including its design, features, functionality, and all content provided by TradeTrkr (excluding User Content), is owned by TradeTrkr and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
The Service integrates with third-party services including:
Anthropic (Claude AI) - for trade analysis
Stripe - for payment processing
PostHog - for analytics
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SECURITY.
We do not warrant that:
The Service will be uninterrupted, timely, secure, or error-free
Results obtained from the Service will be accurate or reliable
Defects will be corrected
The Service or servers are free of viruses or harmful components
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADETRKR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
You agree to indemnify, defend, and hold harmless TradeTrkr and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of:
Your violation of these Terms
Your User Content
Your trading activities or decisions
Your violation of any rights of another party
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:
Violation of these Terms
Fraudulent or abusive behavior
Non-payment of fees
Legal or regulatory requirements
Upon termination, your right to use the Service will immediately cease. You may request deletion of your data by contacting us at support@tradetrkr.com.
We may modify these Terms at any time. Material changes will be notified via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property disputes.
